1. Agreement to Terms

By accessing or using PhotoPlanner AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

PhotoPlanner AI is a web-based platform that helps photographers plan photo sessions by generating AI-powered shot lists, technical camera settings, lighting descriptions, model direction prompts, and visual storyboards. The Service uses artificial intelligence to transform creative briefs into actionable photography plans.

3. Account Registration

To use the Service, you must:

• Be at least 16 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account.

4. Subscription Plans and Payment

4.1 Plans

We offer Free, Pro, and Studio subscription tiers with varying features and usage limits. Details of each plan are available on our pricing page.

4.2 Billing

Paid subscriptions are billed monthly or annually in advance. Payments are processed securely through Stripe. All fees are non-refundable except as required by law.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or harassing
• Create content depicting minors in inappropriate situations
• Infringe on intellectual property rights of others
• Distribute malware or engage in phishing
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Resell or redistribute the Service without authorization
• Use automated systems to excessively access the Service

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, and content (excluding user-generated content), is owned by PhotoPlanner AI and protected by intellectual property laws.

6.2 Your Content

You retain ownership of the content you create (creative briefs, session data). By using the Service, you grant us a limited license to process your content to provide the Service.

6.3 AI-Generated Content

Shot lists, prompts, and storyboard images generated by the AI are provided for your personal and commercial photography use. You may use this content in your photography business.

7. AI-Generated Content Disclaimer

Content generated by AI is provided "as is" for reference and inspiration purposes. While we strive for accuracy, AI-generated camera settings, lighting suggestions, and other technical advice should be validated by the user. Photography conditions vary, and professional judgment should always be applied. We are not responsible for outcomes resulting from following AI suggestions without proper verification.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTOPLANNER AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify and hold harmless PhotoPlanner AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason at our discretion. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Poland.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use after changes take effect constitutes acceptance of the modified Terms.
